Today German Court ruled that the Galaxy Tab 7.7 indeed infringes upon Apple‘s design patent for the iPad, and banned it from sale across the EU. Later on Samsung’s issued statement regarding the sales ban:

Samsung is disappointed with the court’s ruling. We will continue to take all available measures, including legal action, to protect our intellectual property rights and defend against Apple’s claims to ensure our products remain available to consumers throughout the European Union.

There’s no information on why, exactly, Apple was granted this particular victory.

Earlier Apple won a permanent German sales ban against the Galaxy Tab 10.1 but  later The Samsung Galaxy Tab 10.1N came under, a modified version of the original to avoid an injunction and was allowed to go on sale after an appeal by Samsung. Apple again appealed against this new device but today it got approval for sales. Means day was not for only Apple its for Samsung also.

Samsung said on Galaxy Tab 10.1N:

“Samsung welcomes the court’s ruling which confirms our position that the GALAXY Tab 10.1N does not infringe Apple’s intellectual property and does not infringe laws against unfair competition. Should Apple continue to make legal claims based on such a generic design patent, design innovation and progress in the industry could be restricted.”
